RESPONSIBILITIES AND REPRESENTATIONS OF CUSTOMER

Customer represents that all water and waste disposal systems are in good repair and condition and agree to hold Drain Tech (“Company”) harmless for the discovery of any of the following defective conditions:

  • Leaky or defective traps.
  • Hidden or unknown lead piping.
  • Improper or faulty plumbing.
  • Rusted or defective pipes.
  • Corrosion or unusual restrictions due to minerals or hard water buildup.
  • Cleaning chemicals such as lye, sulfuric acid, etc.
  • Pipes, which are settled, broken, deteriorated, or damaged.
  • Existing illegal conditions.
  • Defective roofing.
  • Sump/sewage pumps.
  • Flooding or water damage
  • Back flow valves.

Additional responsibilities and representations of Customer include:

  • Customer shall indicate all property lines, hidden equipment, backflow valves, septic tanks, and sump/sewage pumps and Customer authorizes access through all other properties for Company’s use during work, where access through all other properties is required.
  • Customer is required to obtain permission therefore and agrees to be responsible for and to hold Company harmless from any risks thereof.
  • Customer shall secure worksite and prevent entry thereon by children or animals.
  • Customer is required at his expense to do all work and other acts to meet all conditions necessary to allow Company to complete the work as provided in this Agreement.

RESPONSIBILITIES OF COMPANY – CONDITIONS AND LIMITATIONS –

Company shall do all work in a good and workmanlike manner; however, this responsibility shall not create any obligations that would expand Company’s obligations under the limited warranty.

  • Company is not responsible for any existing illegal conditions or code violations.
  • Company is not responsible for any damage caused by the removal of the cleanout cap, toilets, traps, or drain cover. If, in the opinion of Company, a cleanout cap, drain cover, or housing is so rusted, broken, or fastened as to require its replacement after removal, Company shall notify Customer. If Customer authorized replacement thereof, it shall be made at an additional charge. If Customer refused to authorize replacement, Company shall not be responsible for damage thereafter resulting from sewer, gas, backups, or other leaks through such cap, cover, housing or opening caused by rain or other causes.
  • Company is not responsible for toilets damaged during cleaning unless so indicated on face thereof.

NOTICE AND RELEASE AGREEMENT AND ASSUMPTION OF RISK –

Customer understands that microorganisms such as fungi, bacteria, viruses, etc. are common in the environment. Water intrusions such as water leaks, floods, and sewer backups can increase levels of microbial growth. Customer further understands that the services to be rendered by Drain Tech may have a risk of mold, and Customer agrees to assume the risk of damages and injury, if any, that could result from all mold-related damages resulting from plumbing services. Customer agrees to defend, indemnify, release and hold harmless Drain Tech, its officers, employees, and agents from any loss claim or damage, including but not limited to emotional injury or property damage which results from or is caused by microbial contamination.

LIMITED WARRANTY –

Unless indicated otherwise on the invoice, Company warrants its work to be free from defects in material and workmanship for the warranty period set forth below:
Single-family residential: 30 days
Commercial / Multi-unit / Multi-tenant: 24 hours
Warranties extend only to Customer and are not transferable. Warranties extend only to the original drain cleared. If a defect in materials or workmanship covered by this warranty occurs, Company will remedy within a reasonable time.
To obtain warranty performance, notify Company of any defect claims. The failure to notify Company within 48 hours of the discovery of any defect, leak, or work problems shall void this warranty. All warranties are void if payment is not made when due.

EXCLUSIONS AND LIMITATIONS:

CUSTOMER’S RIGHT TO REPAIR AND REPLACEMENT ARE THE EXCLUSIVE REMEDIES AND COMPANY SHALL NOT BE LIABLE FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES RESULTING FROM THE MATERIALS PROVIDED FOR IN THIS AGREEMENT.
